Agreement to Terms

Welcome to CapsiQueue. These Terms and Conditions (“Terms”) govern your access to and use of the CapsiQueue Platform, including our website, applications, dashboards, APIs, communication systems, and all related services (collectively referred to as the “Platform”). By accessing or using the Platform, you confirm that you have read, understood, and agreed to be legally bound by these Terms in accordance with applicable Indian laws, including the Information Technology Act, 2000, the Indian Contract Act, 1872, and other applicable regulations. If you do not agree with these Terms, you must discontinue the use of the Platform immediately.

Nature of the Platform

CapsiQueue is a technology platform designed to help businesses and customers manage digital queues, appointments, waiting lists, customer flow, and related service coordination.

The Platform acts solely as a technology intermediary and does not directly provide medical, hospitality, professional, governmental, or merchant services. Any services provided at a merchant location remain the sole responsibility of the respective business or organization.

Eligibility and Registration

  • You must be at least 18 years of age to use this Platform independently.
  • By creating an account or using the Platform, you confirm that the information provided by you is accurate, complete, and lawful, and that you possess the legal capacity to enter into a binding agreement under Indian law.
  • Users are responsible for maintaining the confidentiality of their login credentials and for all activities conducted through their account. CapsiQueue reserves the right to suspend, restrict, or terminate accounts involved in suspicious, fraudulent, misleading, abusive, or unlawful activity.

Use of the Platform

  • License: We grant you a limited, revocable, non-exclusive license to use the Queue Management System for personal or authorized business use.
  • Accuracy: You agree to provide true and accurate information when joining a queue. Providing false mobile numbers or names may result in the cancellation of your queue slot.

Terms of Service

  • Non-Transferability: A queue position is linked to your mobile number and cannot be sold, traded, or transferred.
  • Maintaining Order: Users are expected to arrive within a reasonable time once notified regarding their turn or appointment.
  • No-Show Policy: Repeated failure to arrive at the merchant location when your turn is called may result in a temporary suspension of your ability to join future queues.
  • Merchant Responsibility: CapsiQueue is a technology provider. The actual service (e.g., medical checkup, restaurant seating) is the sole responsibility of the Merchant.

Merchant Responsibilities

Businesses and merchants using CapsiQueue are expected to manage customer queues fairly, transparently, and responsibly.

Merchants remain solely responsible for the services they provide, including customer service quality, pricing, operational decisions, cancellations, refunds, fulfilment of services, and legal compliance.

CapsiQueue shall not be held liable for disputes, dissatisfaction, negligence, delays, misconduct, or deficiencies arising from merchant-provided services.

Payments and Subscriptions

Certain features of the Platform may require payment, subscription charges, or service fees. Wherever applicable, pricing information and taxes, including applicable GST, shall be displayed before payment confirmation.

Payments may be processed through authorized third-party payment gateways. CapsiQueue does not store complete banking or card credentials on its systems. Users acknowledge that payment processing may be subject to third-party terms, technical limitations, and external provider policies.

Prohibited Activities

You are strictly prohibited from:

  • Using automation tools, scripts, scraping technologies, malware, or unauthorized technical methods to manipulate queues, extract data, interfere with platform operations, compromise security, or disrupt services.
  • Interfering with the platform's API or backend systems.
  • Submitting "patently false" information to mislead merchants or other users.
  • Using the platform for any defamatory, obscene, or unlawful purposes.
  • Unauthorized activity that violates applicable laws, harms the Platform, affects other users, or compromises operational integrity may result in civil or criminal legal action under applicable Indian laws as well as immediate suspension, investigation, or legal action.

Intellectual Property Rights

All content on www.capsiqueue.com, including the "Capsi-Queue" trademark, software code, and UI design, is owned by CapsiQueue. Any unauthorized reproduction will lead to legal action under the Copyright Act, 1957.

Third-Party Services

CapsiQueue may integrate with third-party providers, including cloud hosting services, analytics providers, communication systems, SMS gateways, authentication services, and payment gateways. Such third-party services may operate independently, and CapsiQueue shall not be responsible for external outages, service interruptions, payment failures, or provider-specific policies.

Limitation of Liability & Disclaimer

The Platform is provided "as is." While we strive for 100% uptime, we are not liable for:

  • Technical delays in SMS/Notification delivery due to telecom network issues.
  • Loss of queue position due to internet connectivity problems on the user's end.
  • Any indirect or consequential losses resulting from the use of the Platform.

Indemnification

Users agree to indemnify and hold harmless CapsiQueue, its directors, employees, affiliates, partners, and service providers from claims, liabilities, damages, legal proceedings, penalties, losses, or expenses arising due to misuse of the Platform, violation of these Terms, infringement of third-party rights, or non-compliance with applicable laws.

Termination

We reserve the right to suspend or terminate your access to the Platform without notice if we suspect fraudulent activity or a breach of these Terms.

Governing Law and Dispute Resolution

These Terms and Conditions shall be governed and interpreted in accordance with the laws of India. Any dispute arising in relation to the Platform shall first be attempted to be resolved amicably through mutual discussions and mediation.

If unresolved, such disputes shall be subject to the exclusive jurisdiction of the courts located in Jodhpur.
